Terms & conditions
RELATIONSHIP BETWEEN THE AFFILIATE AND MYARTPRINTS.CO.UK
Each affiliate of MyArtPrints.co.uk shall print the applicable General Terms and Conditions. We reserve the right to change these terms and conditions at any time. Any modification coming from customers is not enforceable and does not have any effect on the existing contract.
MyArtPrints.co.uk will provide the affiliate with links from his website to MyArtPrints.co.uk website. Subject to the terms of this Agreement, MyArtPrints.co.uk will pay the affiliate a commission in accordance with MyArtPrints.co.uk commission structure.
AFFILIATE RESPONSIBILITY FOR HIS WEBSITE
For the duration of this Agreement, the affiliate agree that his website doesn’t include: pornographic contents, extreme political contents, force glorifying contents or any other contents, which does not respect legal norms and generally recognized ethical principles applicable in the UK or Europe. The affiliate must agree that his website will not infringe any intellectual property rights of a third party; will not violate the rights of any person or third party; will not link directly to any material which is in breach of the provisions of this Agreement. If at any time during the Term any part of the his Website is not in accordance with the provisions of this Agreement, then the affiliate shall remove the offending part of the content of The affiliate website and replace it with alternative content which is not in breach of this Agreement.
RESPONSIBILITY OF MYARTPRINTS.CO.UK
Each affiliate must provide MyArtPrints.co.uk with accurate and valid information (name, billing address, …).
MyArtPrints.co.uk is responsible for the quality, content and supply of all customer orders to the MyArtPrints.co.uk website. Without limitation, MyArtPrints.co.uk is responsible, at its cost, for processing all customer orders, including receiving, filing, shipping and handling, collecting payment. MyArtPrints.co.uk alone is responsible for all aspects of the sale of their goods or services and the relationship with the customer and the affiliate is not involved in the transaction between Merchant and Customer and will bear no liability in that respect.
All customer orders shall be placed directly with MyArtPrints.co.uk. By the only effect of ordering a product on MyArtPrints.co.uk, each customer accepts the applicable General Terms and Conditions of the sale and purchase contract on the day of the order; each customer receives an order confirmation by email, such email being the only document that will be communicated to him to confirm the acceptance by S&S of his order. Such document only mentions the information sent by the customer, and related to the order processed on MyArtPrints.co.uk. General Terms and Conditions can be printed or downloaded from www.myartprints.co.uk, on the day of the order.
COMMISSIONS
The standard commission structure within the Agreement is 10% of the completed order value after deducting delivery charges, current discounts, royalties fees and taxes.
MyArtPrints.co.uk will create, following the completion of each calendar quarter during the term of this Agreement, a report detailing the total Commission payable by MyArtPrints.co.uk for that period based on the agreed commission paid on resultant sales. Payment will be made to the address of the affiliate supplied on registration, and it is the affiliate responsibility to ensure that these details remain accurate and up-to-date.
How and when do you get your money ?
You will receive a 10% commission on any order received by MyArtPrints.co.uk and coming from your website, link or banner. As soon as an order is processed, you will receive a copy of the e-mail sent to the customer and confirming the order and its features. As such, you can easily track the orders you have generated. Your commission will be paid by cheque once a month, appreciatively 2 to 4 weeks after every generated order.
When do you not get paid ?
Even if you have received an order confirmation from MyArtPrints.co.uk, there are exceptions when we can not issue a commission. Possible reasons for such exceptions include:
•So-called hoax orders with false customer addresses;•When someone has placed a double order by mistake;•For any reason the order has been returned to MyArtPrints.co.uk;•If the customer payment isn’t processed for any reason (credit card or debit declined etc.);•Or if you place an order yourself. This programme cannot be used as a way of gaining discount. You should contact us to take part in our business buyer programme;•In addition, no commissions are paid on artist’s licenses fees applicable on some products;
COPYRIGHT AND LICENSES
Subject to the licence granted to the affiliate under this agreement, MyArtPrints.co.uk reserves all of its rights, title and interest in its copyright, trademark, design and other intellectual property rights of the MyArtPrints.co.uk and our trade marks, service marks, logos and other distinctive brand features of the MyArtPrints.co.uk website.
MyArtPrints.co.uk grants the affiliate, during the duration of this Agreement: a non-exclusive, royalty-free, world-wide licence to use, transmit, reproduce and display the Trade marks, as supplied to the affiliate by MyArtPrints.co.uk, on the affiliate’s website for the purpose of enabling the Link; provided, however, that any promotional or other materials containing the trade marks will be subject to MyArtPrints.co.uk prior approval. All goodwill arising in the trade marks out of any use of any of the trade marks by the affiliate will inure solely to the benefit of MyArtPrints.co.uk.

MISCELLANEOUS
MyArtPrints.co.uk reserves the right to amend the provisions of this Agreement at any time. It is the affiliate responsibility to check whether this Agreement has been amended. Your continued use of the Service after any amendments to the provisions of this Agreement shall be deemed to be your binding acceptance of such amendments.
Either party may terminate this Agreement on seven days notice by e-mail to the other without prejudice to its other rights and remedies. Such notice will be deemed to have been received six days after posting unless the sending party receives a communication that the notice was undeliverable. Any outstanding commission will be paid to the affiliate within 30 days of the cessation of the agreement between the affiliate and MyArtPrints.co.uk. Nothing in this Agreement shall exclude or limit liability for death or personal injury resulting from the negligence of either party or their servants, agents or employees. Neither party shall be liable to the other for any indirect, consequential or special damages arising out of or in connection with this Agreement.
Each party to this Agreement represents and warrants to the other that it has, and will retain during the term, all right, title and authority to enter into this Agreement, to grant to the other party the rights and licences granted in this Agreement, and to perform all of its obligations under this Agreement. The affiliate shall fully indemnify and keep fully indemnified MyArtPrints.co.uk (and its staff) on demand against any liability, damage, expense, loss, claim or cost suffered by MyArtPrints.co.uk as a result of any breach by the affiliate of his obligations under this Agreement.
APPLICABLE LAW
Place of fulfilment and jurisdiction is Hamburg (Germany).
Existing Standard terms and conditions are governed by the laws of Germany and of England.
